Fringe festivals throughout North America – including Winnipeg, have become hugely hostile locations for anyone who has expressed support for Israel

By BERNIE BELLAN What happens when a fringe festival performer, who also happens to be Jewish, doesn’t shy away from voicing their support for Israel? In today’s world that performer is bound to be subjected to a torrent of hate – both online and in person.
Such was the case in Winnipeg recently when Melanie Gall, a longtime performer at Winnipeg’s Fringe Festival, found herself caught up in an organized campaign of harassment and bullying – culminating in calls to boycott her shows and defacement of her posters.
To begin, here’s a brief bio of Melanie which should give a good idea how accomplished she is: “Melanie Gall is a professional musician and music historian who holds advanced degrees from several academic institutions, including Manhattan School of Music in New York, Mozarteum University in Salzburg, and Glenn Gould School in Toronto. Melanie is an internationally-acclaimed performer and has sung at Lincoln Center and Royal Albert Hall. She has also written several plays featuring historic music and “Ingenue,” about Deanna Durbin and Judy Garland, had a sold out Off-Broadway run at SoHo Playhouse and won a Best Musical Award at the Adelaide Festival. Melanie divides her time between Alberta, Canada and New York City. She also hosts the Savvy Girls Podcast with her sister.”

As a personal aside I first met Melanie in 2015 at that year’s Winnipeg Fringe Festival. It has been my practice for years to give any Jewish performer at the Winnipeg Fringe Festival some advance publicity – both on this website and within the pages of The Jewish Post & News (now called The Jewish Post). I’ve had a chance to talk with Melanie before, but until this year she had never mentioned that her being Jewish had caused any problems for her.
This year was different, however. While there were several other Jewish performers at Winnipeg’s Fringe Festival I didn’t hear of anyone else being subjected to an organized campaign of harassment the way Melanie was. I did receive an email on July 20 from another Jewish performer by the name of Randy Ross who told me he was upset by seeing a pro-Palestinian demonstration march through Exchange Square – the centre of Fringe activity. Randy said that he and “another Jewish woman told fringe folks we were offended. Festival staff was nice and receptive.”

I hadn’t heard of anything else that might have been construed as antisemitic until I happened to be speaking to another Fringe performer by the name of Jem Rolls (who isn’t Jewish) after the Winnipeg Fringe was over. During the course of our conversation Jem asked me whether I was aware of what had been happening to Melanie Gall? When I said I wasn’t, Jem told me that not only had she been subjected to harassment in Winnipeg, but that she had encountered an even worse form of harassment in Edmonton, which is where she is scheduled to next appear.
As a result I contacted Melanie and asked her to describe what had happened to her in Winnipeg, also what was going on in Edmonton (where that city’s fringe festival is not slated to begin until August 15.)

Melanie explained that she has not been shying away from maintaining a very strong pro-Israel stance on social media, specifically Instagram. “Nobody (in the fringe circuit) has been quite as vocal online as I have the past nine months,” she said. Melanie added though that “I have not said anything against Palestinian rights. I have said ‘What about the hostages?’ “
But these day anyone who is brave enough to post support for Israel on social media is setting themselves up for vicious condemnation – which is something Melanie had been quite aware of, but which has not led to her backing down from her position.
Still, she realized that certain venues this year would be far too hostile for her to consider participating in those fringe festivals. As she told me, “I purposely didn’t do any shows on the West Coast because everyone (who’s a fringe festival performer) I know on the West Coast is a virulently anti-Israel performer.”
As well, Melanie ruled out performing in two other fringe festivals where she had performed in previous years: Halifax and Orlando.
“Halifax was posting antisemitic things so I wasn’t going to go to Halifax,” she noted. As for Orlando – “the Queers for Palestine came in,” so she decided not to go to Orlando either.
But, in contrast with those two fringe festivals, Melanie had been assured that Winnipeg’s Fringe Festival would not tolerate the kind of harassment that she knew she would receive in those other cities.

Winnipeg’s Fringe Festival has traditionally been the second largest fringe festival in North America, surpassed only by Edmonton’s.
And, to be fair, when Melanie Gall began to experience overt antisemitic behaviour on the part of some Winnipeg Fringe volunteers and online during her recent stay here, she did say that her interaction with Chuck McEwen was quite positive. “Chuck was wonderful,” she said. “I have a few emails from him apologizing for what had been happening.”

So, what happened to Melanie during her stay in Winnipeg, from July 17-28?
To begin with, Melanie explained, she “was told no one was allowed to wear pro-Palestinian symbols if they were on staff. I showed up to my first performance (at the Manitoba Theatre for Young People) and my tech was wearing a pro-Palestinian pin. The next day a volunteer at my venue was wearing a kaffiyeh.”
Still, even with that, Melanie wasn’t sure that she was being singled out for harassment.
However, on the third day, she said, “the site supervisor came and was wearing a pro-Palestinian symbol” and told Melanie that he was wearing that deliberately because he was coming to Melanie’s venue.
He told her, “that stance you’re taking (on social media) is a political symbol.”
“That person was relieved” from his duties after Melanie complained to the Fringe office staff, she noted.
Melanie was also the target of an organized campaign on pro-Palestine social media calling for her shows to be boycotted.

On her last day of performing at the Winnipeg Fringe, Melanie says, her “tech came wearing a pro-Palestinian symbol. He was walking back and forth with that symbol.” (She didn’t say what the symbol was.)
Yet, despite what was happening toward her, Melanie says “at no point did I ever demand that they (volunteers or paid staff) take off” their pro-Palestinian pins or other symbols of support for Palestine.
Notwithstanding Melanie’s not having demanded that anyone remove pro-Palestinian symbols, a site supervisor by the name of Eric Rae posted on social media words to the effect, “We have a Zionist in our midst harassing pro-Palestinians.”
As Melanie said during our phone conversation, “This is so ridiculous. I’m being harassed and bullied because I’m Jewish…it’s not about Israel.”
And, while Fringe Festival organizers in Winnipeg took her complaints very seriously, according to Melanie, “it still went to hell.”

The Edmonton Fringe Festival is adding an entirely new dimension of antisemitism to what she has already experienced, Melanie observed. The show she is planning on performing was actually written by her mother, Karen Gall. It’s a show about funny Alberta landmarks.
In order to enhance the show, Melanie and Karen asked the Edmonton Fringe for a designer who could contribute a digital component to the show.
But, as part of her show, Melanie wanted to include a picture of her working on a kibbutz in Israel. After she told that to the artistic director of the Edmonton Fringe Festival, Murray Utas, Melanie says, the next day she was told by Murray that “the designer had pulled out. It was against their ideology to work with us.”
What also concerns Melanie is the possibility that the pro-Palestine network in Winnipeg will have established contact with a similar network in Edmonton to call for boycotting Melanie and Karen’s show.
As she says, “it’s one thing for them not to work with me – which is egregious in itself” (as the designer who was supposed to work with their show decided), “now I’m known as a Zionist. I’m no longer under the radar here.”

The Jewish National Fund is taking the federal government to court after its charitable status is revoked

By JONATHAN ROTHMAN (CJN) The Jewish National Fund of Canada is taking the federal minister of national revenue to court over Canada Revenue Agency’s decision to revoke its status as a charitable organization.

The federal tax agency’s review of JNF’s funding activities followed reports that it was funding projects in Israel related to the military, which would violate Canada’s rules for charitable organizations.

JNF’s court filing says it will contest CRA’s “wrong and unjustified decision to revoke our charitable status,” according to a letter from JNF’s board president Nathan Disenhouse and CEO Lance Davis posted online July 25.

The organization says that while the matter is before the courts, JNF’s charitable work will continue, “including collecting donations and issuing charitable receipts.”

The CJN made multiple requests for an interview to JNF, including to Davis specifically. While JNF did not grant an interview, the organization provided an emailed response to The CJN’s questions about the matter.

“The CRA has only signaled its intention to revoke, and its policy is to revoke only after the charity’s avenues of appeal are exhausted. So, it is the status quo until there is a court ruling. In the interim, we remain open to working with the CRA on alternate courses of action,” JNF told The CJN.

In its federal court appeal notice, JNF also posits there is a “reasonable apprehension of bias in the decision,” saying Canada’s revenue minister “was under great public pressure to revoke [JNF’s] registered charity status.”

JNF maintains the core issue for the revocation remains “the CRA’s assertion that our original founding charitable object that it accepted almost 60 years ago is now no longer considered to be a charitable object.”

Media reports about JNF’s struggles with the CRA since the July 24 court filing have inaccurately referenced past projects, conflating two different matters, Disenhouse and Davis wrote in an email to Canadian supporters on July 30. JNF sought to “clear up a misconception” it said had been “advanced in numerous articles recently published about JNF Canada,” they wrote in the July 30 email.

“The articles conflated the matter of JNF’s community projects on IDF bases and our recent notice of confirmation to revoke our charitable status. In the June 26, 2024 correspondence from CRA, there was not one mention of the projects on IDF property.”

Some of the previous projects, critics of JNF alleged over the past decade or so, had taken place on land that crossed into the West Bank, or involved infrastructure supporting the military, like building playgrounds on a military base. (One of its fiercest critics, Independent Jewish Voices (IJV), a Canadian Jewish group which supports the boycott and sanctions movement against Israel, has been involved for more than a decade in the attempt to have CRA revoke JNF’s charitable status.)

“The fundamental issue was with respect to our charitable purpose. It was very unfortunate that certain journalists shared content from articles about JNF Canada from many years ago that was not referenced in CRA’s recent correspondence,” Disenhouse and Davis wrote to supporters.

In the late 1960s, the minister of national revenue approved the organization’s purposes and activities, and so “we did not know that there was an issue with our purposes or activities because previous CRA audits did not reveal an issue,” JNF wrote to The CJN in a response to emailed questions.

The organization has been audited five times by the CRA since it began in the 1960s, with the most recent audit in 2014. As a result of that audit, which was based on work done in 2011 and 2012, JNF learned in 2019 that the CRA intended to revoke its charitable status.

JNF said that since the original notice of intent to revoke was issued in 2019, the CRA has been unwilling to meet in person with them.

JNF points out that, according to CRA’s website, they revoked three to five percent of charities audited, “and a large number of them are for failing to file their annual documentation with the CRA. It is evident, based on the statistics, that it is only in rare occurrences is a charity revoked.”

JNF’s email went on to explain that CRA had refused to pursue options other than revocation of its charitable status.

“There are a number of options available to the CRA aside from revocation and we do not understand why they would pursue the most punitive course of action,” JNF wrote.

JNF said CRA had not taken the steps that are outlined on its website, including “exploring compliance measures such as education letters, compliance agreements and sanctions before revoking an organization’s charitable status.”

“The CRA not only skipped steps one to three, it also refused to entertain our suggestions of new objects for our charity or to discuss a compliance agreement,” wrote JNF in the email, adding that CRA representatives “refused to sit down with us at any point in the 10 years of this audit, except for one meeting a few months ago when two representatives of the appeals division granted us an hour and arrived at the meeting with no agenda and no questions for us.”

Bias in the audit, JNF claims

JNF said its appeal filing argues that “there is a reasonable apprehension of bias in the audit.”

An access to information request made it evident “that there was a campaign of anti-Israel organizations, unions, political parties, etc. calling upon the CRA to revoke JNF’s charitable status.

“We have written to the CRA with our concerns that this content may have biased the audit process. CRA replied in writing that there was no bias in the audit. 

“This evidence of bias comes from the CRA’s own records, which show that the public pressure on the CRA and the minister to revoke JNF’s status was an important consideration within the chain of authority at the Charities Directorate,” the charity told The CJN.

JNF clarified its position regarding potential CRA bias.

“To be clear, we are not suggesting the CRA is antisemitic,” JNF wrote.

“As a Zionist-inspired organization, however, JNF Canada has many vociferous antisemitic detractors who we believe have influenced the decision-making process in this matter. “

The work done by JNF

Established in 1967, JNF, one of Canada’s oldest Jewish charities, is known for its tree-planting and environmental work in Israel, along with building playgrounds for children. Its more recent projects include JNF Quebec division’s Climate Solutions Prize, which encourages the development of innovative technology addressing climate change by nonprofit institutions and early-stage companies.

However, some of JNF’s projects, which its critics allege support the Israeli military or are on land in the West Bank, have made it the focus of scrutiny by Canadian critics of Israel. Adding to that scrutiny, former prime minister Stephen Harper—criticized by some for his pro-Israel stance–was a visible JNF supporter during his years in office, and JNF named the visitor centre at its Hula Valley bird sanctuary in Israel which opened in 2006 for Harper,

In its email to The CJN, the charity says that it has “systematically and comprehensively addressed” the issues raised in CRA’s 2014 audit.

“Although we do not concede that building parks and playgrounds on IDF land is a violation of charity law, we are no longer are involved with projects on IDF land or any projects that may in any roundabout way benefit the IDF.

“While JNF Canada disagrees that it is contrary to Canadian foreign policy to develop projects on disputed territory (there are dozens of Canadian charities that operate in the disputed territories with CRA’s blessing), we have not supported new projects in the disputed territories since this matter was brought to our attention.”

JNF said that it has an Israeli lawyer review issues of land ownership before undertaking a project “so that we can be certain that we are not doing anything in violation of CRA policies,” and that it had hired a new chief financial officer “who has worked closely with our legal counsel to enhance our record keeping.” 

On its website, JNF says its mission currently is “focusing our efforts on the greatest needs in social and environmental infrastructure.”

“We will continue to raise funds in support of building Israel’s charitable social infrastructure to the benefit of vulnerable populations such as youth-at-risk, victims of domestic abuse, children with special needs, veterans and the disadvantaged” while the court appeal proceeds, JNF wrote.

“JNF Canada’s projects benefit all residents of Israel regardless of their religion, ethnicity, creed, [or] orientation.”

Years of anti-Zionist activism led to this moment

The current legal challenge follows years of scrutiny from opponents of the organization, including but not limited to IJV.

IJV’s national coordinator, Corey Balsam, who trumpeted the victory on social media, said the decision came after years of the group’s work on this file, though he noted JNF’s court appeal notice.

“Can’t believe it happened! IJV started working on this 15 years ago, building on decades of work by Ismail Zayid and others,” posted Balsam, referring to one of the four individuals IJV had helped to organize the campaign to have JNF’s charitable status probed and removed over JNF’s Canada Park project.

In 2017, IJV filed a complaint against JNF with federal authorities, alleging that the charity’s activities contravened the Income Tax Act, international law and CRA guidelines.

Then, in a highly critical CBC News article in January 2019, reporter Evan Dyer wrote that JNF had been the subject of the CRA audit over a complaint that it used charitable donations to build infrastructure for the Israel Defense Forces “in violation of Canada’s tax rules.” (JNF maintains that its last CRA audit was in 2014, though conflicting reports reference an audit in 2018. The notice of intent to revoke JNF’s status by CRA is dated August 20, 2019.)

JNF pushed back on the allegations that JNF Canada and its Israeli parent organization, Keren Kayemeth LeIsrael (KKL-JNF), were supporting projects at several military bases, including outdoor fitness areas, developing a new training base, upgrading an existing auditorium for solider intake and new mess hall facilities at two air force bases.

JNF Canada says it stopped funding those projects in 2016 following CRA guidance and told Dyer for that report that JNF operates within CRA rules concerning the organization’s charitable status.

JNF’s CEO, Lance Davis, said at the time the projects were carried out on land owned by the IDF, but that JNF Canada’s charitable funds never flowed to the IDF.

Davis told The CJN in 2019 that with regards to projects “in disputed territory,” JNF is committed to continuing to work with the CRA “to ensure we are in full compliance,” and referred to a 2015 opinion piece in The CJN written by Alan Baker, Israel’s former ambassador to Canada, which argued that the land on which Canada Park sits was “never part of any Palestinian state or entity.”

In 2021, JNF Canada announced it had distanced itself from KKL-JNF which is “an Israeli public benefit corporation.”   

“KKL serves as an agent to JNF Canada on a number of our charitable projects. This means that KKL works for JNF Canada in realizing projects that our board selects and agrees to fund. There is a long history between our organizations and we proudly collaborate with KKL on a variety of projects that advance Zionist education and enhancing the environment as well as the quality of life for the people of Israel,” JNF wrote in its email to The CJN.

“There was confusion with respect to the relationship between the two organizations so we rebranded to clarify that we are an independent Canadian charity.”

What the CRA has to say

A spokesperson for CRA declined The CJN’s request for an in-person interview, instead offering written responses to questions.

Addressing JNF’s allegations of anti-Israel sentiment within the CRA’s ranks influencing the charitable status revocation decision, CRA spokesperson Nina Ioussoupova told The CJN via email that the agency is “committed to administering acts for which it is responsible in a fair and impartial manner.”

“The CRA assesses all concerns about registered charities against a clear regulatory and risk framework designed to prevent bias in our decision-making process,” she wrote.

“Additionally, the CRA has a responsibility to protect the integrity of the tax system and the charitable sector and fulfills this responsibility through a balanced program of education, client service, and responsible enforcement, including audits.”

Citing confidentiality provisions under the laws it administers, CRA declined to comment on specific details of court cases.

The website Charity Intelligence Canada currently lists JNF Canada at a one-star rated charity. “JNF Canada is not financially transparent. Its audited financial statements are not posted on its website nor provided when requested,” the website reported.

Its last audited financial statements in 2022, show that JNF received $13.2 million in donations and spent $6.2 million on programs and grants, according to the Charity Intelligence page. JNF Canada’s reserve funds are $30.8 million, the website reports.

“JNF Canada works in Israel and Canada. Its programs in Israel focus on funding social and environmental infrastructure, while its Canadian projects focus on outreach and education in Jewish communities,” the Charity Intelligence page reads.

The website lists the charity’s five core programs as Builders Circle, Climate Solutions Prize, JNF Education, JNF Families, and JNF Future, but notes that JNF “does not provide a breakdown of spending by program.”

As of July 26, Charity Intelligence Canada has updated its JNF page with the following information:

“After nearly [five] years of review and exchanges with JNF Canada, the CRA Charities Directorate announced its decision to revoke its charity status. This would mean that support for JNF Canada no longer receives donation tax receipts. JNF Canada is appealing this decision claiming that the CRA Charities Directorate’s decision is wrong and unjustified.”

We received a request for assistance to help Jo Ann Greisman return to her Winnipeg home from Israel, which is where she had received advanced immunotherapy treatment. Jo Ann was diagnosed with stage 4 melanoma just over a year ago. Walking was difficult post-surgery, especially during a Winnipeg winter, so she went to stay with (daughter) Jennie and family in Israel, where they have advanced treatments unavailable in Canada, and planned to come home in the spring. Unfortunately, she began to experience severe and life-threatening side effects from the continued immunotherapy, which resulted in extended hospitalization.

She persevered and made it out of hospital, and wants nothing more than to return home to see the rest of her family, her friends, and her doting dog. But she is unable to take a commercial flight due to unmanageable pain in her abdomen, tailbone, and back. Inoperable tumors leave her unable to sit for the long journey or endure the multiple layovers, and she can only get home by medical flight.

The cost for this service is over $110,000 CAD, and it provides her with the stretcher service, air ambulance, and medical escort needed to get her home.

Former Winnipegger Rabbi Shawn Zell’s new book  a reflection on loss of loved ones

By MYRON LOVE Rabbi Shawn Zell’s newest publication, “Meaningful Mourning: Reflecting on the Life and Death of a Loved One,” is a thought-provoking and comprehesive contemplation of dealing with the process of grieving. In essence, “Meaningful Mourning” is a follow up to the former Winnipegger’s earlier book, “For Those Who Grieve,” which was published three years ago.
In an earlier interview with the Jewish Post regarding “For Those Who Grieve,”, Rabbi Zell noted that “one of the greatest frustrations when it comes to a shivah house is that, all too often, the atmosphere leaves much to be desired” – with people telling jokes, catching up on gossip and generally avoiding the subject of death and dying rather than rather than “sharing words of comfort and reflection and anecdotes and recollections of the deceased.”
“For Those Who Grieve,” he continues, aims to replace “tired and worn” readings in current shivah books with his own compositions which, he hopes, will give readers “new food for thought” that may “serve as a source of comfort to the bereaved and render the atmosphere of the shivah house more meaningful.”
‘What compelled me to write Meaningful Mourning”, Rabbi Zell says, “is to offer suggestions that may help clergy as well as others are uncomfortable dealing with.” 
He cites, as an example, the funeral of a mentally-handicapped individual in our community roughly 50 years ago where Rabbi Peretz Weizman officiated.  The individual was hit by a bus.
“I still recall Rabbi Weizman’s well-thought out words  that the deceased had a tragic life and died a tragic death.” 
Rabbi Zell also spoke of a more recent funeral at which he officiated where the widow was very angry that her husband had died.  “The deceased had become involved in a dispute with the city over some property. His wife was adamant that he not try to fight city hall. He persisted and died of a heart attack.  I tried to focus on appreciation of his life.”
In the introduction to “Meaningful Mourning,” he notes that “rifts in families are not uncommon. But how many readings in our canon broach such subjects?” he asks.
“And,” he continues, while Judaism makes it quite clear that you should choose life over death, there are occasions when one gives up one’s life to protect others.”
“Meaningful Mourning” consists of 15 chapters, each with a specific theme and each divided into a series of two-page readings – consisting of an exposition of how each day of the week, each month of the year, every Jewish festival, can provide comfort to mourners. Each reading also consists of a relevant poem and psalm.
In the first chapter, for example – which focuses on the daily order of creation, one comment in particular caught my attention – and made me think:  When someone I  know died suddenly, I sometimes wonder what that individual had planned for the rest of the day, what celebrations were coming up, what trip might the deceased have been  looking forward to? 
I recall one fellow coming to the evening minyans at my shul to say kaddish for his brother.  Then, one day, he didn’t appear.  I subsequently heard that he had developed an infection and died unexpectedly.  I remember thinking that he wasn’t supposed to die. He still had several months left to say kaddish.
As Zell points out in “Meaningful Mourning,” “unlike the creation process, death does not necessarily wait for the deceased to complete everything he hoped to accomplish.  In many cases, death has been compared to an unfinished symphony.
“From the Jewish perspective, the Angel of Death has little, if any, regard for projects yet to be completed, plans yet to be realized and dreams yet to be fulfilled.”
Another reading speaks of the signs of the zodiac and their connections to the equivalent Jewish months.  “The sign for the month of Shvat is Aquarius, the water carrier,” Zell observes.  “In Judaism, water is prayed for because water is seen as a blessing.  But what happens when the natural flow of water is interrupted?  How do we respond when tranquil water is usurped by troubled or turbulent water i.e., death?
“In a perfect world, the mourner would find solace in believing that he enriched with happiness and joy the one who was summoned from above.”
The accompanying reading with this topic is a poem intended to bring some comfort for mourners who are overcome with remorse or regret.
 In “One Small Step,” Zell riffs on the immortal words of astronaut Neil Armstrong, the first man to step foot on the moon.  “Little did Neil Armstrong realize that he was echoing the words of many a religious leader counselling a bereaved individual,” the rabbi comments.  “Mourning that is proper and effective is a process of small steps and giant leaps.”
A leap of faith is necessary for several reasons, Zell adds, most of all so that the mourner is not consumed by pangs of guilt for not having been a better child, sibling or spouse. He quotes Ecclesiastes in saying that “when the dead is at rest, let his remembrance rest.”
“I hope that the readings in this book help to lessen the pain for the bereaved,” he writes.   
 Zell, who was formerly the spiritual leader of Congregation Tiferet Israel in Dallas, grew up in Winnipeg. The son of the late Ida and Phil Zell was initially ordained as a Conservative rabbi in the mid-1980s. He served in pulpits in that capacity in Sioux City, Iowa, and Clark, New Jersey. In 2004-2006 – while between congregations, he received his Orthodox smicha.  He currently lives in retirement in New Jersey..
